Stephen Moniak is an experienced member of the firm’s Business Litigation, Education, Employment & Labor, and Appellate practice groups. Mr. Moniak regularly represents clients in business and employment litigation in state and federal courts. Mr. Moniak provides advice and representation to school districts in all types of matters, including employment, labor and litigation.
Mr. Moniak's practice includes ERISA litigation, collective bargaining, employee and student discipline, employment covenants, executive compensation, health care, trademarks, patents, trade secrets, corporate control, business torts, fraud, RICO, contracts, and many other issues arising under state and federal laws.
Some of Mr. Moniak’s recent representations include:
- Representation of a directed trustee of a trust fund and plan involving hundreds of employers against ERISA claims alleged by the U.S. Department of Labor. Solis v. Koresko et al., No. 09-988, 2009 U.S. Dist. LEXIS 78538, 53730, 53741, 43701, 43731, and 44357 (E.D. Pa.).
- Successfully represented several national banks in federal court litigation involving alleged predatory lending practices. Hearns v. Parisi et al., 548 F. Supp.2d 132 (M.D. Pa. 2009); Wilson v. Parisi et al., 549 F. Supp.2d 637 (M.D. Pa. 2009); Jeppson v. Parisi et al., 3:CV-05-0564, 2007 U.S. Dist. LEXIS 97477 (M.D. Pa. Oct. 4, 2007).
- Representation of local school districts in litigation before administrative, county and appellate courts in Pennsylvania. Coatesville Area Sch. Dist. v. Coatesville Area Teachers’ Ass’n/Pennsylvania State Educ. Ass’n, 978 A.2d 413 (Pa. Cmwlth. 2009).
- Successfully won dismissal and transfer of claims against rail equipment manufacturer by formers sales agent. Intertran Corp. v. Railquip, Inc., 1:CV-08-0684, 2008 U.S. Dist. LEXIS 64794 (M.D. Pa. Aug. 22, 2008).
- Obtaining and preserving a judgment for a third party administrator against a health plan sponsor in the Fourth Circuit Court of Appeals. Great-West Life & Annuity Ins. Co. v. Info. Sys. & Networks Corp., 523 F.3d 266 (4th Cir. 2008).
- Obtaining a judgment for a health plan sponsor against a plan participant’s claims under COBRA and ERISA. Hall v. Glenn O. Hawbaker, Inc., 4:06-CV-1101, 2007 U.S. Dist. LEXIS 70431, 8669; 2006 U.S. Dist. LEXIS 81760 (M.D. Pa.).
- Representing shareholders and officers of a company in trademark and corporate control litigation. Doeblers’ Pa. Hybrids, Inc. v. Doebler, 442 F.3d 812 (3d Cir. 2006).
