When a corporate client is sued, its board of directors and officers are often named as defendants. In such circumstances, those individuals often need, and are entitled to, independent representation. Rhoads & Sinon is well-known for its representation of individual directors and officers in the face of complex and difficult litigation.
We work closely with company counsel, recognizing, however, the need for complete independence and a duty to defend our individual clients. We counsel our clients on matters critical to their independent defense of litigation.
In many cases, such representation is covered by insurance. We have extensive experience in negotiating coverage under these policies for potential actions, and in aiding individuals in obtaining coverage or recovery from an insurer in the event such coverage was warranted. We are able to convince carriers to appoint our firm to represent individual directors and officers, because of our reputation for success in the defense of such claims. We also regularly act as local counsel in litigation filed in the United States District Court for the Middle District of Pennsylvania, providing both procedural and substantive guidance to lead counsel.
