Stark and Anti-Kickback Laws, Medicare/Medicaid Fraud and Abuse

The firm has had substantial experience in analyzing the impact of federal and state laws governing physician referrals (Stark II, Anti-Kickback Statute and related state laws), including structuring financial arrangements with physicians and restructuring physician joint ventures and other relationships to comply with those laws.  The firm has also had substantial experience in analyzing issues arising under the Medicare and Medicaid fraud and abuse laws, including the False Claims act, and in providing related consultation, advice, and legal structure recommendations.

The firm has represented a number of clients in evaluating potential fraud and abuse situations, preparing voluntary self-disclosure statements, negotiating settlements, and representing parties in matters before the U.S. Department of Justice, the federal Office of Inspector General, and state Medicaid fraud units.

Finally, the firm closely monitors legislative and regulatory initiatives as well as investigative and litigation activity regarding fraud and abuse and Stark II law issues.  The firm's attorneys regularly lecture on developments in these areas.
